We endeavor to respect the intellectual property of others and ask our users to do the same. If you believe your copyrighted material has been posted on this site without your permission and without qualifying for a legal exception such as fair use, you may submit a notification to our Digital Millennium Copyright Act (“DMCA”) Agent as set forth below.
Copyright Owners:
The notification you submit must contain the following six items to be effective. We recommend that these items be numbered and provided in the same order as shown below:
- A description of the copyrighted work that you claim is being infringed (preferably including a URL under your control displaying the same material);
- Identify and indicate the specific location on the RSI Services of the material you claim is infringing and wish removed (preferably including its URL on the RSI Services);
- Acknowledge the following statement by including it in your notification: “I affirm that I have a good faith belief that the use of the described material in the manner complained of is not authorized by the copyright owner, its agent, or the law”;
- Agree to the following statement by including it in your notification: “I affirm, under penalty of perjury, that the information in this notification is accurate, and that I am the owner, or an agent authorized to act on behalf of the owner, of the exclusive right that is allegedly infringed”;
- Your contact information, including all of the following:
- a. Your job title (if related to the legal basis of your authority to issue this complaint)
- b. Your legal name
- c. Mailing Address
- d. Telephone Number
- e. Email address
- Your electronic or physical signature as the copyright owner or as the owner’s authorized agent.
For effective results, the description should make a direct comparison of your copyrighted work against its appearance on the RSI Services. If a description or location you provide is unclear, we may require more clarification to proceed. Please note that you must be either the copyright owner or its authorized agent in order to send effective notification under the DMCA. If you believe someone else’s copyright has been infringed, you may contact the owner and inform them, but you won’t have the legal authority to send an effective DMCA notification. Your notification may be shared with the person having posted the material which you wish removed.
By submitting a copyright takedown notification, you are initiating a legal process. Abuse of this process or repeated false claims or misrepresentations may result in the suspension or termination of your access to RSI Services or other legal consequences, including liability or damages under Section 512(f) of the DMCA.
Counter-Notification: “My content should not have been removed!”
If we receive a DMCA notification regarding content posted by you, you may receive a corresponding notification. Note that repeated notifications of infringement against you may result in the suspension or termination of your access to RSI Services.
If you believe you have the legal right to post the material that was removed, you may respond with a counter-notification to our DMCA agent. A counter-notification is a legal request to reinstate the content that was removed, either due to mistake or misidentification, or because your use of the material qualifies for a legal fair use exception.
Per the DMCA, an effective counter-notification must contain the following five items:
- Description, and former location of the content that was removed;
- Agree to the following statement by including it in your counter-notification: “I affirm, under penalty of perjury, that I have a good faith belief that the material described herein was removed or disabled as a result of mistake or misidentification of the material”;
- Agree to the following statement by including it in your counter-notification: “I consent to the jurisdiction of the Federal District Court for the judicial district in which the address I provide below is located, or, if outside the United States, for any judicial district in which RSI may be found, and I will accept service of process from the complainant.”;
- Your contact information, including all of the following:
- a. Mailing Address
- b. Telephone Number
- c. Email address
- Your electronic or physical signature.
Be aware that your counter-notification, including your name and contact information, will be shared in full with the original complainant, and that s/he may pursue separate legal redress in response. Under the law, a complainant has 10 business days after receiving the counter-notification to present RSI with evidence that they have initiated a court action to further enforce his/her rights.
